WorkHorse Investments, LLC, doing business as WorkHorse Service Company Software (“WorkHorse,” “we,” “us,” or “our”), provides payment technology that allows customers to make payments to businesses using WorkHorse software (“Merchants”).
This Privacy Policy explains how WorkHorse collects, uses, retains, and protects information when you use a WorkHorse payment page.

1. Our Privacy Commitment
WorkHorse does not sell your personal information.
WorkHorse also does not:

  • Rent your personal information
  • Share personal information for cross-context behavioral advertising or targeted advertising;
  • Provide payment information to data brokers;
  • Use payment information to advertise unrelated products or services; or
  • Allow unrelated third parties to use your information for their own marketing.

We disclose information only as necessary to provide the payment service, process transactions, support the Merchant, comply with the law, prevent fraud, and protect the security of the payment system.

2. WorkHorse’s Role
The company identified on your invoice or payment page is the Merchant receiving your payment. The Merchant determines the amount you owe and how your payment is applied to your account.
WorkHorse provides the technology used to:

  • Display invoices and balances;
  • Collect payment instructions;
  • Submit transactions for processing;
  • Create and associate payment tokens with customer accounts;
  • Record payment results;
  • Apply payments to invoices; and
  • Provide transaction records to the Merchant.

Payments are processed through a third-party payment processor. The processor communicates with banks, card issuers, card networks, ACH networks, and other financial institutions necessary to complete the transaction.

3. Information We Collect
Depending on how you use the payment page, we may collect the following categories of information.
Contact and Account Information

  • Name;
  • Billing address;
  • Service address;
  • Email address;
  • Telephone number;
  • Customer or account number; and
  • Information connecting you to the Merchant.

Invoice and Transaction Information

  • Invoice numbers;
  • Amounts due and paid;
  • Payment dates;
  • Transaction status;
  • Merchant information;
  • Payment confirmation or reference numbers;
  • Refunds, reversals, disputes, or returned payments; and
  • Notes or payment instructions you provide.

Payment Information
Payment information may include:

  • Payment-card information;
  • Bank-account and routing information;
  • Account type;
  • Card expiration date;
  • Name associated with the payment method;
  • Billing ZIP code;
  • A token representing a saved payment method; and
  • Limited information such as the payment method type and last four digits.

Sensitive payment information is submitted to or processed through a third-party payment processor. WorkHorse may receive a secure token and limited payment details necessary to process and record transactions.
Device and Technical Information
When you access the payment page, we may automatically collect:

  • IP address;
  • Browser and device type;
  • Operating system;
  • Date and time of access;
  • Referring page;
  • Session and security information;
  • Activity involving the payment page; and
  • Error, performance, and fraud-detection information.

4. How We Use Information
WorkHorse uses personal information to:

  • Process and record authorized payments;
  • Create payment tokens when you choose to save a payment method;
  • Apply payments to invoices and customer accounts;
  • Provide payment confirmations;
  • Display transaction histories and account balances;
  • Communicate payment results to the Merchant;
  • Investigate declined, disputed, duplicate, reversed, or returned payments;
  • Provide customer and technical support;
  • Detect, investigate, and prevent fraud or unauthorized activity;
  • Maintain the security and reliability of WorkHorse;
  • Meet accounting, auditing, contractual, and legal requirements;
  • Enforce our terms and protect our legal rights; and
  • Improve the operation and performance of the payment service.

WorkHorse does not use your bank-account or payment-card information for unrelated advertising or marketing.

5. How Information Is Disclosed
We may disclose information to the following parties only for legitimate business, payment-processing, security, or legal purposes.

The Merchant
We disclose transaction, customer, invoice, and payment-status information to the Merchant you are paying. The Merchant may use that information to manage your account, apply payments, issue refunds, and provide customer service.
The Merchant’s handling of your information may also be governed by its own privacy policy.

Payment Processors and Financial Institutions
We disclose payment instructions and transaction information to the third-party payment processor and, as necessary, to banks, card issuers, card networks, ACH operators, acquiring banks, and other financial institutions involved in the transaction.

Service Providers
We may use companies that provide hosting, security, communications, data storage, fraud prevention, technical support, auditing, or other services on our behalf.
These providers may access information only as necessary to perform their services and are not permitted to sell or use the information for their own independent marketing purposes.

Legal and Security Disclosures
We may disclose information when reasonably necessary to:

  • Comply with a law, regulation, subpoena, court order, or lawful government request;
  • Investigate fraud, unauthorized transactions, or security incidents;
  • Enforce applicable agreements;
  • Protect WorkHorse, the Merchant, our users, or another person;
  • Respond to a payment dispute or chargeback; or
  • Establish, exercise, or defend legal claims.

Business Transactions

If WorkHorse is involved in a merger, acquisition, financing, reorganization, or sale of some or all of its business or assets, information may be disclosed as part of that transaction. Any recipient would remain responsible for handling the information in accordance with applicable law.

6. We Do Not Sell Personal Information
WorkHorse has not sold personal information and does not sell personal information for money or other valuable consideration.
WorkHorse does not share personal information for cross-context behavioral advertising or targeted advertising.
Disclosures to the Merchant, payment processors, financial institutions, and service providers for the purposes described in this Privacy Policy are necessary to provide the payment service and are not made for advertising purposes.

7. Saved Payment Methods and Tokens
If you choose to save a payment method, the third-party payment processor may securely retain the payment credentials and provide WorkHorse with a token representing that payment method.
WorkHorse may associate the token with your customer account so that the payment method can be selected for a future transaction.
Saving a payment method does not, by itself, authorize automatic or recurring payments. A separate authorization is required for recurring payments.
You may contact the Merchant to request that a saved payment method be removed. Removing it will not delete records of transactions that were previously completed.

8. Cookies and Similar Technologies
The payment page may use cookies, session identifiers, or similar technologies necessary to:

  • Keep the payment page functioning;
  • Maintain your session;
  • Remember transaction progress;
  • Prevent fraud;
  • Protect account security; and
  • Diagnose technical problems.

WorkHorse does not use the payment page to track you across unrelated websites for advertising purposes.

9. Data Security
WorkHorse uses administrative, technical, and physical safeguards designed to protect personal information from unauthorized access, loss, misuse, or alteration.
Payment information is processed through third-party payment services designed to comply with applicable payment-card security requirements. However, no electronic system or internet transmission can be guaranteed to be completely secure.
You should protect access to your devices, email accounts, payment information, and payment confirmations.

10. Data Retention

We retain information only for as long as reasonably necessary to:

  • Process and document transactions;
  • Maintain accurate Merchant and customer account records;
  • Provide customer support;
  • Resolve disputes, returns, and chargebacks;
  • Prevent fraud and maintain security;
  • Satisfy accounting, contractual, and legal requirements; and
  • Enforce our agreements and protect our rights.

Retention periods may vary depending on the type of information, the Merchant’s instructions, payment-network requirements, and applicable law.
Transaction records may be retained after a saved payment method is removed or a customer relationship ends.

11. Your Privacy Rights
Depending on where you live and subject to applicable exceptions, you may have the right to request that WorkHorse:

  • Confirm whether we process your personal information;
  • Provide access to personal information associated with you;
  • Correct inaccurate personal information;
  • Delete certain personal information;
  • Provide a portable copy of certain information; or
  • Explain the categories of information we collect, use, and disclose.

Because WorkHorse frequently processes information on behalf of a Merchant, we may direct your request to the Merchant or coordinate with the Merchant before responding.
We may need to verify your identity before completing a request. We will not discriminate against you for exercising a privacy right.
WorkHorse does not sell personal information or share it for targeted or cross-context behavioral advertising, so there is no sale or advertising-related sharing from which you need to opt out.

12. Children’s Privacy
The WorkHorse payment service is intended for adults making authorized payments. It is not directed to children under 13, and WorkHorse does not knowingly collect personal information directly from children under 13 through the payment page.
If you believe a child has provided personal information through the payment page without appropriate authorization, contact us so that we can review the matter.

13. Third-Party Websites and Services
The payment page may contain links to the Merchant, payment processor, or other third-party websites. WorkHorse is not responsible for the privacy practices of websites or services that WorkHorse does not control.

14. Changes to This Privacy Policy
We may update this Privacy Policy when our services, legal obligations, or privacy practices change.
The “Last Updated” date at the top identifies the most recent version. Material changes will be communicated as required by applicable law.
